Freedom of Information Act Requests
Inspection files will become available for public viewing only after:
- a decision has been made not to issue a citation, and the inspection has closed;
- the employer has acknowledged receipt of a citation, has not filed a contest, and the inspection has closed; OR
- a final order is entered following a contest with the Administrative Law Court, and the inspection has closed.
Witness identity, witness statements, complainants' identity, financial statements, and accident or injury records maintained by the employer are exempt from disclosure.
All whistleblower discrimination files are confidential and exempt from disclosure, except to the employee who filed the claim or their authorized representative.
